UK Citizens Continue to File Asbestos Talc Claims In US Courts

It has come to the notice that many UK residents have started filing their lawsuits in US courts. This has been happening due to the growing number of diagnosis of mesothelioma cancer which is due to the asbestos contaminated talc.

Well, this no no longer hidden. Due to the world's highest per capita rate of mesothelioma, UK is slowly and steadily contributing to the changing faces of asbestos litigation in the US.

There have been reports stating mesothelioma traced to various occupational asbestos exposure among men are dropping. On the other hand, cases due to the non-occupational asbestos exposure continue to rising.

You might have observed Asbestos-contaminated talc found in beauty and health products has now become a growing trend. There is a valid proof to show the burgeoning number of cases that are linked to different brands of talc.

The first court case in this regard surfaced in the year 2016 which became the one to spark the debate of increase in the international product liability filings.


Asbestos Contamination Cases Linked to US Products

Daniel Wasserberg, who's a renowned asbestos litigation specialist said, “You may think that living in the UK, you are not able to file a case within the U.S. court system, but that’s not entirely true,” he said.

In a discussion to asbestos.com, he said, “If you have [asbestos] exposure that relates back to American-branded companies or to products manufactured here in the United States, you may be able to avail yourself of a courtroom in the United States.” he stated.

It's known that Wasserberg is quite specialized in dealing wit the asbestos contaminated talc which has mostly been found in products like baby talc, body powders and many other products.

The above has also been found in a large number of moisturizers, creams, and makeup products.

Some well known cases of asbestos contaminated talc initially involved UK residents. While some other products involved some American products that were sold outside the country.

A well known company Johnson & Johnson, that currently faces a large number of asbestos litigations continue to manufacture its products to a plethora of countries.

As per the latest report, it was stated that almost 450 to 500 women residing in the UK are diagnosed annually with mesothelioma. 

The risk is more as such cases are currently on a surge. It's due to the fact that 7% annual increase in cases have been found in the recent past.


Johnson & Johnson Leads Talc Litigation

As you are quite aware of the fact, Johnson & Johnson continues to be the biggest name in the talc litigation. The number of cases are so large that over 40,000 cases are still pending.

Although, the company clearly states that they have analyzed every product and no product is now contaminated with asbestos, litigation in talc lawsuits continue to surge with an amazing rate of $3 billion.

Looking at the above number of surge in the asbestos related litigations, it was in August 2022 when J&J announced not to sell its talc-based Johnson’s Baby Powder in 2023.

In fact, the company took the drastic decision to completely stop the circulation of such products in the US and Canada in 2020.

There are some other cosmetics giants who also faced similar asbestos related litigation include the names like Estee Lauder, Clinique , Chanel, and Avon.

Please note that there are only a few cases of contaminated talc involving mesothelioma which is a rare and dreaded cancer caused due to the long term asbestos exposure. 

The majority of cases due to this contamination lead to the risk of developing ovarian cancer or any other serious type of illness.

As far as talc contamination is concerned, it basically stems from where the two naturally occurring minerals are found on the earth.
